This website (hereinafter "Website") and all the services provided herein (hereinafter "Services") are not intended for minors under 16 years of age and NGEN S.r.l. – SB, in its capacity as data controller (hereinafter "Company" or "Controller"), does not intentionally collect personal information from minors. In the event that information on minors is unintentionally recorded, the Controller shall, at the request of users, delete it promptly.

Legal basis and purpose of processing

The Company informs you that the processing of your personal data will be carried out for the purposes set out below:

without express consent: to enable Customers to access part of the Company's website (hereinafter "Website") dedicated to the online sales of its products (hereinafter "Products") and, consequently, to enable Customers to carry out all applicable purchase procedures, as well as to enable the Company to carry out all the various administrative, commercial, accounting and tax activities related to online sales as well as, more generally, to execute the relevant legal obligations and to exercise the right of defence, where necessary; in relation to these purposes, your consent is not required because the processing of the data is necessary to provide the Services requested or to comply with a legal obligation;
only with specific and separate consent: to enable registration for the company newsletter.

Data storage period

Your personal data will be processed for the time strictly necessary for the pursuit of the above-mentioned purposes, after which it will be deleted or made anonymous. Where personal data is linked to a specific account created by Customers at the time of their registration to the Website, the Company will automatically proceed to deletion of the data if the Customers do not make an online Product purchase within 24 months of their last purchase. For the purpose of registering for the company newsletter, your personal data will be processed until your possible request to stop the service and, in any case, for the time strictly necessary to pursue the above-mentioned purposes, after which it will be deleted or made anonymous.

Nature of data provision and consequences of refusal

The provision of data for the Purposes referred to in point A) is necessary in order to register with the Website and to take advantage of the services offered. The provision of data for the purpose referred to in point B) is optional. You may therefore decide not to submit any data or to subsequently deny the possibility of processing data already provided: in this case, you will not be able to receive advertising and informative material, information regarding the Company's products and services, as well as any further initiatives, commercial or otherwise, launched by the Company. You will continue to receive the services referred to in point A).

Scope of data disclosure and categories of recipients

Exclusively for the purposes specified above, all the data collected and processed may be disclosed to internal figures authorised to process it based on their respective duties, as well as to the following categories of external subjects: banks, transport and shipping companies, external structures that collaborate directly with the Company in the technical and informative management of the Website and any other external figure to whom it may be necessary to disclose the data. These recipients, should they process data on behalf of the Company, will be designated as data processors by contract or other legal deed.

Data transfer to a third country and/or an international organisation

Your personal data will not be transferred to non-European countries.

Rights of data subjects

You are entitled (see Articles 15-22 of the GDPR) to request our Company to access your personal data and correct it if it is inaccurate, to delete it or limit its processing if deemed appropriate, as well as to obtain the portability of data provided by you only if it is subject to automated processing based on your consent or contractual terms. You also have the right to withdraw the consent given for processing purposes that require it, without prejudice to the lawfulness of the processing carried out up to the time of such withdrawal. You also have the right to file a complaint with the competent supervisor, i.e. the Italian Data Protection Authority [Garante per la protezione dei dati personali].
